NOTICE OF PUBLIC HEARING- RESCHEDULED
TAKE NOTICE that the Michigan Department of Environmental Quality’s (MDEQ) Water Resources Division (WRD) will hold a public hearing in the Dale B. The purpose of this hearing is to secure the views of interested persons concerning the following application for permit:
Application for permit HNH-TFMB-YPBP9 under Part 301, Inland Lakes and Streams, and Part 303, Wetlands Protection, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (NREPA), by the Charter Township of Texas, 7110 West Q Avenue, Kalamazoo, Michigan 49009. The applicant proposes to temporarily pump water from Eagle Lake and Crooked Lake into wetlands, Bass Lake, the West Fork of Portage Creek, and Atwater Mill Pond to relieve flooding. Water will be pumped from Eagle Lake into Crooked Lake at a rate of 1,500 gallons per minute (GPM), and from Crooked Lake to wetlands adjacent to Bass Lake at a rate of 3,000 GPM. Number 24 mesh screening will be used for the Crooked Lake pump to prevent transfer of invasive species. Pumping is proposed to lower the water surface elevation of Eagle Lake approximately 2.2 feet and Eagle Lake approximately 4.4 feet. Pumping will continue until the elevation of Eagle Lake reaches 899.8 feet and Crooked Lake reaches 892.9 feet. Once the lakes reach the targeted elevations, in 120 to 360 days
depending on precipitation, pumping will continue to maintain normal water levels. Water levels and pumping will be monitored weekly and after rain events exceeded 1/2 inch. Pumping will proceed on a 13-day on, 2-day off schedule to minimize impacts to Eastern Massassauga Rattlesnake. The pumped water will increase water levels in approximately 31 acres of wetland and is modeled to increase water levels by approximately 1 foot on Bass Lake and approximately 6 inches within the West Fork, Portage Creek and adjacent wetlands downstream to the west of U.S.-131. The project is located in T03S, R12W, Sections 01, 02, 11, 12, 14 and 15, Texas Township, and T03S, R11W, Section 06, City of Portage, Kalamazoo County, Michigan, in accordance with plans attached to this notice.

Any written comments to be submitted for the public hearing record must be received at this address on or before the close of the record.
The hearing will be held pursuant to Section 30105(2) of Part 301 of the NREPA. The hearing will not be a legal proceeding, witnesses will not be sworn, and there will be no cross examination. Public hearings are primarily informational and are held to encourage the expression of views and presentation of facts.
The MDEQ will, upon written request, provide a copy of the MDEQ’s decision on this application.
